Winnow Digital Services Inc. (“WinnowPro”) is a provider of live chat and digital marketing software and services for automotive dealerships. This privacy policy (“Privacy Policy”) describes how WinnowPro handles the personal information that we collect from and about you when you (a) visit our website (the “Site”), (b) interact with an integrated chat interface we operate on behalf of our automotive dealership customers on their websites (“Dealership(s)”), or (c) otherwise engage with us through our newsletters, emails, and branded social media accounts (collectively, the “Services”). 

For purposes of this Privacy Policy, “Personal Information” means personally identifiable information that can be specifically associated with, or that is sufficient to identify, you and includes your name and contact information (your phone number, address or email address). 

This Privacy Policy applies to information we collect and use for our own purposes, including providing the Services and marketing our business. This Privacy Policy does not apply to Personal Information WinnowPro processes on behalf of Dealerships. In these situations, WinnowPro is a service provider for the Dealership and all communications you have through the integrated chat interface (and all Personal Information collected therein) are processed by WinnowPro in accordance with our agreement with that Dealership.

Information We Collect. 

We collect information that you voluntarily provide in the following ways: 

  • When you fill in forms on our Site. When you fill in forms on our Site, including when you contact us for additional information or request ameeting with our sales team, we may require that you provide us with certain information such as your name, business contact details, organization, and information about your current advertising practices such as monthly advertising spend and current advertising channels.
  • When you subscribe to our Services and set up a Site account. If you choose to purchase our Services, you will be required provide our third-party payment processor with your payment card information, which can include your name, card number, expiration date, security code, and billing address. To set up your account, we ask that you provide us with certain information including your name, business contact details, business category and URL. We also ask that you create a unique username and password to sign-in to your account. Later you may personalize your dashboard with additional information including XXXX.
  • When you sign up to receive email communications from us or complete a survey. When you engage in these activities, we may collect your name, email address or other contact details, company name, job title, industry, areas of expertise, interests, an any additional information you provide to us as part of that request (such as information about your satisfaction with our Services in response to a survey.
  • When you contact us. When you contact us by email; through our branded social media accounts; through our integrated chat providers; or by telephone, SMS, or physical mail, we may collect your name, username, contact information, company name, job title, and the contents of your communication, which can include any information you choose to provide.
  • When you interact with an integrated chat interface we operate on a Dealership website. When you visit a Dealership website that uses our integrated chat interface, if you engage in any live web chat or SMS conversation using our services, we may also store any transcripts (“Transcripts”) from such conversations and link those Transcripts to your Personal Information. 

We may also obtain and use data and information about your online activity or metadata about you (such as geolocation data) either on or off the Website from third-party sources in order to improve your experience with WinnowPro or the Website and to provide the services. 

We do not knowingly collect or maintain information provided by children under the age of sixteen (16). If a child has provided us with Personal Information without parental or guardian consent, the parent or guardian should contact us and we will remove the information.

How your Behavioral Information is Collected and Used.

To enhance your experience and provide more personalized service, we may use a feature called a cookie or other similar tools to track your behavior on the Website. Cookies are small files that your web browser places on your computer’s hard drive. They are used for a variety of purposes, such as tracking click behavior. Data that is tracked through these mechanisms may include, but are not limited to: (i) your domain name; (ii) your IP address; (iii) the type of web browser, device and operating system being used; and (iv) the pages of a Website that you visit or the files that you request. 

WinnowPro does not currently change its behavior in response to web browser "do not track signals. However, if you do not want use to collect information through the use of cookies, most internet browsers enable you to block cookies, limit the type of cookies you allow, or set your browser to alert you when cookies are being set in the preferences or settings of the internet browser. Please refer to your browser’s documentation for instructions on how to block cookies in your browser’s settings.

We use Behavioral Information to better understand how visitors use the Website in order to deliver a more personalized experience for you on the Website and in the Dealership’s physical store, and to improve our services to better meet your needs. We may also use cookies in order to help us or third parties display advertising to you when you visit the Website or third-party sites based on your interest displayed by your behavior on the Website.

Linking Behavioral Information to Personal Information.

If you voluntarily provide WinnowPro with your name and contact information through a web chat or web form submission, we may link your Behavioral Information to your Personal Information. We may provide this linked information to the Dealership you have submitted your Personal Information on, as well as use this data to improve your service and experience on the Website.

How We Use Your Personal Information. 

We use the information described above to do the following: 

  • Provide our Services (including creating your account and identifying you when you sign in; managing your access to and use of our Services; fulfilling your requests, registrations, and purchases; and sending you technical notices, updates, security alerts, and support and administrative messages); 
  • Operate and improve our Services (including monitoring and analyzing usage, trends, and activities related to the Services and identifying, fixing, and troubleshooting bugs and service errors);
  • Communicate with you (including responding to your requests, inquiries, comments, and suggestions); 
  • Personalize content (including tailoring content we send or display to you in order to provide you with news and information we think will be of interest to you); 
  • Further our networking, marketing, and social strategies (including posting testimonials; notifying you about programs, services, offers, promotions, and events; and promoting our programs and services);
  • Protect against, identify, investigate, and respond to misuse of our Services (including preventing and detecting fraud, unauthorized access, and other unlawful behavior); 
  • Support our general business operations (including maintaining our business and legal recordkeeping); and 
  • Carry out any other purpose described to you at the time the information was collected. 

To Whom Your Information is Disclosed.

We may share Personal Information about you with certain third parties in the following circumstances: (a) WinnowPro’s third-party service providers, (b) the Dealerships to whom WinnowPro is providing services to (or such Dealerships’ third-party service providers) and whose website you have submitted your Personal Information on; (c) to other third parties that you consent to (for example, a finance company, bank, or other financial institution when you request credit eligibility or apply for financing through a Dealership), and (d) companies under common control and ownership with WinnowPro. 

Anonymous or aggregated Behavioral Information, meaning Behavioral Information that does not include Personal Information, may be shared with third parties in order to improve your overall internet experience, display more relevant internet advertisements to you based on your interest in and behavior on the Website, or provide aggregated statistical data for reporting and analytics purposes.

We also may share your Personal Information, Behavioral Information and Transcripts as we deem necessary to respond to a subpoena, regulation, binding order of a data protection agency, legal process, governmental request or other legal or regulatory process.

Communication.

WinnowPro or the Website owner may need to communicate with you for a variety of reasons, including but not limited to:

  • If you submit a contact form with your Personal Information
  • If you have a live chat or SMS conversation or similar interaction and submit your Personal Information
  • If you request credit eligibility information or apply for financing

Consent.

By using any of WinnowPro’s Services, you confirm that you have agreed to our Terms of Services, and to the extent permitted by law, have read and understood this Privacy Policy. 

Protection of Personal Information.

Your Personal Information is stored in WinnowPro’s databases (or WinnowPro’s service providers’ databases) using security practices in accordance with industry standard practices. Although we make reasonable efforts to protect Personal Information from loss, misuse, or alteration by third parties, you should be aware that there is always some risk involved in transmitting information over the internet and storing information electronically. WinnowPro cannot and does not guarantee absolute security. 

In some cases, your Personal Information may be stored in the Dealership’s databases (or the Dealership’s service providers’ databases). Please refer to the Dealership’s privacy policy for more information about the measures they use to safeguary your Personal Information. 

How You May Access, Update or Delete Your Personal Information.

If you want access to your Personal Information, you may make a request to WinnowPro at the contact address below. In some cases, WinnowPro may direct you to contact the relevant Dealership to help you with your request. You may also access update, or delete certain Personal Informaiton you have provided through your account settings in your dashboard. 

Please note that we may keep certain Personal Information as necessary to comply with our legal obligations or for legitimate business purposes, such as to resolve disputes or enforce our agreements. We may also keep cached archived copies of Personal Information for additional time. 

How Long We Retain Behavioral Information and Personal Information.

We retain records of your Personal Information in our databases for so long as reasonably necessary for the purposes described in this Privacy Policy, as required by law, or as necessary to resolve disputes and enforce our rights and agreements. Data may persist in copies made for backup or business continuity purposes for additional time.
